Terms and Conditions of Sale

Terms and Conditions for Renovation Nation DBA Auction Pittsburgh: This is a legal agreement between you, the user or buyer, and the Site Owner or Auction Company. You must be at least 18 years old to bid. 

  1. Agreement: By accessing this site and utilizing the services of Auction Pittsburgh as Buyer, or by registering as a Buyer regardless of your location, you agree that: You have read these Terms and Conditions of Sale, you understand these Terms and Conditions of Sale, and you are bound by these Terms and Conditions of Sale in your use of these Terms and Conditions of Sales and use of this Site. Auction Pittsburgh refers to any registered person on the site as a User/Buyer.
  • Registration: Before bidding, users are assigned an account name and password upon registration. All users are responsible for all actions taken under their account name and password. All bids are final once submitted. There are no retractions. 
  • Payment Terms: The purchase price is the sum of the bid price, buyer’s premium of 10%, sales tax of 6%. If the item is not paid for in full within three (3) days, the item will be considered abandoned and/or forfeited to Auction Pittsburgh. Auction Pittsburgh reserves the right to relist/resell all items considered to be abandoned or forfeited when invoice is not paid in full. All payments must be in U.S. funds. 
  • Notice:
    • Buyer’s Premium: There will be a 10% Buyer’s Premium on all purchases. 
    • Sales Tax: Westmoreland County, Pennsylvania Sales Tax is 6% on all purchases. 
    • Forms of Payment: Visa, Mastercard, Discover, and American Express cards are accepted.
  • Pickup, Removal, & Failure to Remove: All purchases must be removed from the auction site within 5 days after payment without damaging any property and within the scheduled time picked by you, the buyer. The buyer accepts all responsibility to remove all items from the auction site. If for any reason the buyer fails to remove purchases within the time specified, all items will be considered abandoned and forfeited, and Auction Pittsburgh shall have the right to resell, remove, or discard said purchases. 
  • Exclusion of Users: Auction Pittsburgh reserves the right to exclude any user from any selling event or block registration of the user if the user has breached or threatens to breach these Terms and Conditions or engages in any behavior that Auction Pittsburgh deems to have adverse effects on the selling event or the reputation of Auction Pittsburgh. A user will be excluded from all selling events by Auction Pittsburgh if the user fails to complete payment in full within the specified time frame. If the buyer fails to complete payment in full three times, The buyer will be banned from future auctions. Refer to “Payment Terms” above.
  • Seller Bidding Terms: All sales are made on an AS IS-WHERE IS WITH ALL FAULTS/ NO REFUNDS/ NO RETURNS/NO EXCEPTIONS basis. All buyers are urged to physically inspect the item(s) during the inspection period. No bids can be withdrawn after the auction for any reason. Buyer understands that any description given on the item is not guaranteed, and BUYER will rely entirely on their own inspection. All information and descriptions contained in advertising this sale is believed to be correct, but no responsibility is assumed by Auction Pittsburgh for any errors or omissions.
    • We are liquidators, therefore, some of our products are non-warranted, second quality, close-outs, shelf-pulls, returns, as well as many warranted and first-quality products. MAKE SURE THE QUALITY OF THE PRODUCT YOU ARE PURCHASING WILL MEET YOUR EXPECTATIONS. Your expectations and your interpretation of “waste” will greatly affect the outcome of your project, regardless of quality purchased. 
  • Conditions:
    • 1st Quality Products- In Stock/Special Orders/ Overstock/ Excess Material/etc. – If warranted by the manufacturer all warranty claims will be directed to the manufacturer. Claims will be decided on by the manufacturer only.
    • Rustic/ Tavern/ Cabin/ Closeout/ 2nd Grade Wood Flooring (10-15% Waste) – May have open knots, color variations, mineral streaking, miss milling of tongue/groove, and other imperfections in the board as well as the finish of the wood. This grade will exhibit a high frequency of shorter board length most of the time. Figure at least 10-15% waste when figuring your square footage. Your expectations and your interpretation of “waste” will greatly affect the outcome of your project. 
    • 2nd Quality and Closeout Porcelain or Ceramic Tile (10-15% Waste) – May have shade variations, glaze imperfections, wet or damaged packaging, no packaging, and/or calibration variations. In some instances, may have broken tile. Figure at least 10-15% waste when figuring your square footage. Your expectations and your interpretation of “waste” will greatly affect the outcome of your project.  
    • Like New – These are items that appear to be in a new condition or have never been used previously. These items are not tested for functionality or completeness. For items that are marked like new, a buyer must examine the item thoroughly at inspection. 
    • Open Box – Open box items were sold by a retailer, and potentially used before being returned by the customer. Open box items may be damaged or have an opened box with missing pieces, so unless the condition of a specific item is explicitly stated, you should not make any assumptions about it other than that it may be ripped, scratched, non-functional, or otherwise damaged. For items that are marked open box, a buyer must examine the item thoroughly at inspection.
    • Damaged – Items marked “damaged” indicate that they could come from a multitude of circumstances. Damaged items could be incomplete and have not been tested for functionality. For items that are marked damaged, a buyer must examine the item thoroughly at inspection.
  • Disclaimer of Warranty and Release: The user expressly agrees that use of this website is at the user’s sole risk. Neither Auction Pittsburgh, its affiliates, nor any of their officers, directors, employees, agents, third-party content providers, or licensors (collectively, “Providers”), or the like, warrant that this site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of this site, or as to the accuracy, completeness, reliability, security, or currency of the site. The site may contain errors, omissions, inaccuracies, or outdated information. Further, Provider does not warrant reliability of any statement or other information displayed or distributed through the site. Provider reserves the right in its sole discretion, to correct any errors or omissions in any portion of the site. Provider may make any other changes to this site at any time without notice. Provider makes reasonable commercial efforts to make the site available at all times, however, provider is not responsible for any service interruptions, including, but not limited to, interruptions that may affect aspects of the sale of items.

10.Limitation of Liabilities: You agree that provider and its providers shall not be liable for any damage, loss, or expense of any kind arising out of or resulting from your possession or use of the materials, content, or information on this site or from your purchase or sale of goods through this site regardless of whether such liability is based in tort, contract, or otherwise. In no event, including, without limitation, a negligent act, shall provider or any of its providers be liable to you for any direct, indirect, special, incidental, consequential, or punitive damages (including, without limitation, loss of profits, loss or corruption of data, loss of goodwill, work stoppage, computer failure or malfunction, or interruption of business), arising out of or in any way related to the materials, content, or information on this site or any other products, services, or information offered, sold, or displayed on this site, your use of, or inability to use, this site generally, or otherwise in connection with this agreement, regardless of whether provider or any of its providers have been advised of the possibility of such damages.
